1. Service Description
[MARCA] operates as a personal shopping concierge service for luxury designer goods. We are not a traditional retailer, reseller, or marketplace. We act as your authorized agent, personally sourcing and purchasing items from authorized retailers and official brand boutiques on your behalf. All items are purchased new from legitimate retail channels and shipped directly to you.
2. How It Works
When you place an order through [MARCA], you are engaging our concierge service to source a specific item on your behalf. Your payment is processed at checkout via Stripe. After your purchase, our team sources the item from our network of authorized retailers and ships it directly to you.
3. Pricing
All prices are listed in United States Dollars (USD). Listed prices include our concierge service fee, sourcing costs, handling, and complimentary shipping. The price displayed at checkout is the total price you pay — there are no hidden fees or additional charges. Prices are subject to change based on availability and market conditions until your purchase is completed.
4. Orders and Payment
All orders are processed immediately at checkout. Payment is collected at the time of purchase via Stripe. We accept major credit and debit cards. [MARCA] does not store your payment card information — all card data is handled directly by Stripe in accordance with PCI compliance standards.
5. Order Limit
Each order is limited to 3 pieces. For larger requests, please contact us directly — we are happy to assist.
6. Order Cancellation
Orders may be cancelled within 30 minutes of purchase. During this window, you may cancel directly from your order page and receive a full refund. After 30 minutes, cancellation is not possible as our team has already begun sourcing your item. If we are unable to fulfill your order for any reason, you will receive a full refund automatically.
7. Item Availability
While we strive to keep our listings accurate, item availability may change. If we are unable to source an item after your purchase, we will notify you promptly and issue a full refund to your original payment method within 5 business days.
8. Shipping
[MARCA] offers complimentary shipping on all orders to addresses within the continental United States. Estimated delivery time is 3 to 7 business days after the item has been sourced and verified. Shipping times may vary depending on item availability and carrier schedules. We are not responsible for delays caused by carriers or events outside our control.
9. Final Sale Policy
All sales are final. Each item is sourced specifically for you upon purchase. We do not accept returns, exchanges, or issue refunds for change of mind, incorrect sizing selected by the customer, or buyer's remorse. Please review all item details carefully before completing your purchase.
10. Claims, Unboxing, and Dispute Resolution
[MARCA] stands behind every item we source. If the item you receive materially differs from its description — including receiving an incorrect size, wrong item, or an item damaged during shipping — please contact us within 7 days of confirmed delivery.
To protect both parties, [MARCA] strongly recommends that customers record a continuous unboxing video prior to and during opening of their delivery. In the event of a claim, photographic and/or video evidence of the unopened package and its contents upon opening will be required. Claims submitted without supporting documentation may not be eligible for resolution.
All claims must include: (a) photographic or video evidence of the item received; (b) original packaging in the condition received; and (c) a written description of the discrepancy. Claims submitted after the 7-day window, or for items showing signs of use or removal of original tags, will not be eligible.
Eligible claims will be reviewed within 10 business days. Resolution may include a full refund or exchange at our discretion. This policy does not cover minor color variations due to photography or screen calibration, normal material characteristics, or issues resulting from customer misuse.
11. Authenticity Guarantee
[MARCA] guarantees the authenticity of every item we source. All items are purchased exclusively from authorized retailers and official brand boutiques. We do not engage with secondary markets, third-party resellers, or unauthorized channels. If you believe an item is not authentic, contact us immediately and we will investigate and resolve the matter.
12. No Store Receipts
As a personal shopping concierge, [MARCA] does not provide original retailer receipts or proof of purchase from retail locations. Your [MARCA] order confirmation serves as your official proof of purchase. Authenticity is guaranteed on every piece.
13. Chargebacks and Payment Disputes
If you have any concerns regarding your order, please contact our support team before initiating a chargeback or dispute with your bank or card issuer. We are committed to resolving issues promptly and fairly. We ask that you contact us first — most issues are resolved within 10 business days without the need for a formal dispute. Initiating a chargeback before contacting [MARCA] may delay resolution and could result in account restrictions.
14. Dispute Resolution and Arbitration
You and [MARCA] agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of our service shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, and the arbitrator's decision will be final and binding. Each party will bear its own costs unless the arbitrator determines otherwise.
You and [MARCA] agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
15. Limitation of Liability
[MARCA] acts as a personal shopping concierge and agent on your behalf. To the fullest extent permitted by law, [MARCA] shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our service. Our total liability for any claim arising from a transaction shall not exceed the amount paid by you for that specific order. [MARCA] is not responsible for manufacturer defects, product recalls, or changes to product specifications made by the brand or manufacturer after purchase.
16. Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of [MARCA] after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
17. Governing Law
These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions.
